End User License Agreement (EULA)

1. Introduction

This End User License Agreement ("Agreement") is a legal contract between you ("User") and nmbr Inc. ("Company") regarding the use of our software and services.

2. License Grant

nmbr Inc. grants you a limited, non-exclusive, non-transferable license to use the software solely for personal or organizational purposes as outlined in this Agreement.

3. Restrictions

You may not:

  • Modify, reverse engineer, or create derivative works based on the software.

  • Sell, distribute, or sublicense the software.

  • Use the software in any manner that violates applicable laws or regulations.

4. Ownership

All intellectual property rights in the software remain with nmbr Inc. This Agreement does not transfer any rights to you except for the limited license provided.

5. Updates and Upgrades

nmbr Inc. may provide updates or upgrades to the software. These updates will be subject to the terms of this Agreement unless new terms are provided.

6. Zero Tolerance Policy

Users must agree to the following terms as part of the EULA: There is zero tolerance for objectionable content or abusive behavior. Any content or behavior that violates these rules will not be permitted.

7. Content Moderation Commitment

nmbr Inc. will act on reports of objectionable content within 24 hours. This includes promptly removing such content and ejecting the user responsible.

8. Termination

This license is effective until terminated. nmbr Inc. may terminate this Agreement if you breach any of its terms. Upon termination, you must cease all use of the software and destroy any copies in your possession.

9. Disclaimer of Warranties

The software is provided "as is" without any warranties, express or implied. nmbr Inc. disclaims all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the maximum extent permitted by law, nmbr Inc. will not be liable for any indirect, incidental, or consequential damages arising from your use of the software.

11. Governing Law

This Agreement is governed by the laws of the State of California. Any disputes will be resolved in the courts of San Francisco, CA.

12. Changes to the Agreement

nmbr Inc. reserves the right to modify this Agreement at any time. Continued use of the software constitutes acceptance of the revised terms.
